These Terms of Service ("Terms") govern your access to and use of the Find Your 'Fit mobile application and the website usefyf.com (collectively, the "Service"), operated by FYF Technologies Inc. ("FYF," "we," "our," or "us"), a Texas corporation.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
You must be at least 13 years old to use the Service. Users between 13 and 17 must have permission from a parent or legal guardian. By using the Service, you represent and warrant that you meet these requirements and that you have the legal capacity to enter into these Terms.

The Service, including all software, design, content, branding, recommendation algorithms, scoring engines, and underlying technology, is owned by FYF Technologies Inc. and is protected by United States and international copyright, trademark, patent, and other intellectual property laws.
FYF's personalization and recommendation technology is the subject of pending patent applications. You may not copy, modify, distribute, sell, lease, or create derivative works based on the Service or its underlying technology without our express written permission.
Product images, brand names, and product information displayed within the Service are the property of their respective owners and are used for the purpose of fashion discovery and affiliate commerce.
When you upload items to your wardrobe, set preferences, or otherwise provide content to the Service, you grant FYF a worldwide, non-exclusive, royalty-free license to use that content solely to operate and improve the Service for you.
You retain ownership of your content and personal data. You can delete user content at any time from within the app.
The Service contains affiliate links to third-party retailers. When you tap an affiliate link and make a purchase, FYF may earn a commission from that purchase at no additional cost to you.
FYF participates in affiliate programs operated by networks including but not limited to Awin, Commission Junction (CJ), Impact, and Sovrn Commerce. Our recommendation engine is independent of these commercial relationships — items are ranked based on your personal style profile, preferences, and behavior, not based on commission rates.
We do not accept payment from brands or retailers to feature their products. Editorial integrity is core to the Service.
The Service provides personalized recommendations, size predictions, and styling suggestions based on the information you provide and your usage of the Service. These recommendations are advisory only.
FYF makes no warranty that:
You are responsible for verifying product details with the retailer before making any purchase. All purchases are governed by the terms and conditions of the third-party retailer.
The Service links to and references third-party retailers. We are not affiliated with, endorsed by, or sponsored by these retailers unless explicitly stated. Your transactions with retailers — including payment, shipping, returns, and customer service — are solely between you and the retailer.
FYF is not responsible for the content, products, services, or practices of any third-party site or app.
Prices, availability, and product details shown in the Service are sourced from third-party retailers and may not reflect the most current information. Always confirm pricing and availability on the retailer's website before purchasing.
You may delete your account at any time from the Settings screen in the app. Upon deletion, your personal data will be removed within 30 days, except where retention is required by law.
FYF reserves the right to suspend or terminate your access to the Service, with or without notice, if you violate these Terms, engage in fraud or abuse, or for any other reason at our sole discretion. Provisions that by their nature should survive termination — including intellectual property rights, disclaimers, and limitations of liability — will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA.
FYF DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOU USE THE SERVICE AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FYF TECHNOLOGIES INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION — ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify and hold harmless FYF Technologies Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms in the app or on our website. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
